Terms and Conditions

1. Summary. Freedom Boat Club’s Discounted Entry Fee for BoatClass Trainees (the “FBC Offer”) is a promotional offer by Freedom Franchise Systems, LLC, its affiliates, and participating franchisees (“Freedom”). Eligible participants who claim the FBC Offer may be eligible to receive a discount from Freedom up to one thousand dollars ($1,000) off the then-current entry fee at participating Freedom Boat Club locations, subject to these Terms & Conditions (the “Terms”).

FBC Offer is subject to all federal, state, and local laws and regulations. Void where prohibited or restricted by law. Eligible participant accepting the FBC Offer represents and warrants that the participant has read, understands, and accepts these Terms, as they may be modified from time to time.

2. Sponsor. The FBC Offer is sponsored by Freedom Franchise Systems, LLC and its affiliates, 897 E. Venice Ave., Venice, FL 34285.

3. Eligibility. The FBC Offer is open to legal U.S. citizens residing in the continental U.S., who are 21+ years of age or older and have successfully completed the BoatClass training as determined in the sole discretion of BoatClass and/or its affiliates. BoatClass training is only available at limited Freedom Boat Club locations and is subject to certain terms and conditions.  See Boatclass.com for further details.

4. Offer Period.  The FBC Offer will be available beginning 12:00 AM EST on January 1, 2024 through 11:59 PM EST on December 31, 2024.

5. Locations.  This offer is only available at participating locations.  For a list, please visit BoatClass.com. Offer participants will need to contact their desired location to confirm participation in this Offer. 

6. Changes to Offer.  Freedom reserves the right to cancel or modify the FBC Offer and these Terms at any time, at its sole discretion, without prior notice.  Changes to the FBC Offer and these Terms will be made by written notice to be posted on Freedom’s website.

7. How to Redeem FBC Offer. Eligible participants can accept this offer by (i) completing the form associated with the following https://www.freedomboatclub.com/boat-class.html ; or (2) mentioning this FBC Offer in person at a participating Freedom location.  FBC Offer must be redeemed at the Club that participant completed the BoatClass training.

a. The Freedom Boat Club membership will only be available to the eligible person(s) accepting the FBC Offer and a legal spouse/domestic partner (“Co-Member”), if applicable.

b. Each eligible participant and Co-Member if applicable that accepts the FBC Offer will be required to: (i) sign the then-current version of the Freedom Boat Club membership agreement; (ii) acknowledge and agree to adhere to the terms and conditions of membership; (iii) complete any required online courses (may vary by location), classroom training courses, and new member orientation as directed; and (iv) provide a credit card for incidental expenses such as fuel. Participant is responsible for fuel and other expenses incurred in connection with his/her Freedom Boat Club membership.

c. Participants must redeem the FBC Offer no more than thirty (30) days after completing the BoatClass training in order accept the FBC Offer.

d. The FBC Offer may be combined with other local promotional offers. Contact desired location for more details.

8. Offer Details. Limit one offer per household during the FBC Offer Period. The FBC Offer is non-transferable and no cash-outs will be provided. No substitutions unless determined in the sole discretion of the Freedom.

9. RELEASE OF LIABILITY. BY PARTICIPATING IN THE FBC OFFER, PARTICIPANT AGREES TO RELEASE AND HOLD HARMLESS FREEDOM, AND THEIR DEALERS AND RETAILERS, AFFILIATES, SALES REPRESENTATIVES, AGENCIES, WHOLESALERS, DISTRIBUTORS, AND PROMOTIONAL AND OTHER VENDOR AGENCIES INVOLVED IN THE FBC OFFER, THEIR RESPECTIVE PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, SERVICE AGENCIES, INDEPENDENT CONTRACTORS, AND THE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES OF ANY OF THE ABOVE ORGANIZATIONS (THE “RELEASED PARTIES”) FROM ANY INJURY, LOSS, OR DAMAGE TO PERSON, INCLUDING DEATH, OR TO PROPERTY DUE IN-WHOLE OR IN-PART, DIRECTLY OR INDIRECTLY, TO THE ACCEPTANCE OR USE/MISUSE OF THE FBC OFFER, PARTICIPATION IN ANY FBC OFFER-RELATED ACTIVITY, OR PARTICIPATION IN THE FBC OFFER.

10. DISPUTES/CHOICE OF LAW. THE FBC OFFER AND THESE TERMS SHALL BE GOVERNED BY THE INTERNAL LAWS OF THE STATE OF FLORIDA, WITHOUT REGARD TO ITS CONFLICTS OF LAWS, RULES, OR POLICIES. FREEDOM AND EACH PARTICIPANT AGREE THAT ANY DISPUTE, CLAIM OR CONTROVERSY ARISING FROM OR RELATING TO THESE TERMS OR ACCEPTANCE OF THE FBC OFFER SHALL BE RESOLVED IN FEDERAL AND STATE COURTS LOCATED IN FLORIDA.

11. Entire Agreement. These Terms constitute the entire understanding between Freedom and each participant with respect to the FBC Offer and supersede any and all prior communications, whether written or oral.

12. Severability. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions of these Terms shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained herein.
